1. About SmileAgent

SmileAgent is a dental triage and booking platform that helps patients in Ireland find and connect with dental clinics. By using SmileAgent ("the Service"), you agree to these Terms. If you do not agree, please do not use the Service.

3. Eligibility

You must be at least 18 years old to use SmileAgent. By using the Service, you confirm that you are 18 or older and are legally capable of entering into a binding agreement.

4. How the Service Works

SmileAgent connects you with dental clinics. When you submit a booking request or emergency referral:

• We forward your details to the clinic you selected
• The clinic reviews your request and contacts you directly
• Submitting a request does not guarantee an appointment. Availability is subject to the clinic's review and capacity
• Your relationship for treatment is directly with the clinic, not with SmileAgent

5. Pricing and Estimates

All prices displayed on SmileAgent are estimates only, sourced from publicly available information and clinic-provided data. Final treatment costs will be confirmed by the dentist after your consultation.

Med 2 tax relief calculations are estimates based on the standard 20% rate. SmileAgent does not guarantee eligibility — this is determined by Revenue and your individual tax circumstances.

SmileAgent does not collect payment from patients. All payment is made directly between you and the clinic.

6. AI Smile Analysis

The optional AI smile analysis feature provides a general assessment to help guide treatment selection. It is not a clinical examination and should not be relied upon as a diagnosis. A qualified dentist will assess your specific needs during consultation.

7. Clinic Information Accuracy

Clinic details (addresses, phone numbers, opening hours, pricing, Medical Card status, PRSI acceptance) are sourced from publicly available information and verified periodically. However, this information can change without notice.

SmileAgent makes reasonable efforts to keep clinic data accurate but does not guarantee the accuracy, completeness, or currency of any clinic information displayed. We recommend confirming details directly with the clinic before attending.

8. Your Responsibilities

• Provide accurate and truthful information when using the Service
• Do not submit false emergency triage requests
• Do not attempt to abuse, disrupt, or reverse-engineer the Service
• Do not submit another person's personal data (including PPSN) without their consent
• Attend booked appointments or notify the clinic of cancellations

9. Intellectual Property

All content, code, design, and branding on SmileAgent is owned by SmileAgent and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.

10. Limitation of Liability

To the fullest extent permitted by Irish law:

• SmileAgent is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for any actions, decisions, or outcomes resulting from the triage tool
• We are not liable for the quality of care, treatment outcomes, or conduct of any dental clinic
• We are not liable for any loss arising from reliance on pricing estimates or tax relief calculations
• Our total liability for any claim shall not exceed the amount you paid to use the Service (which is currently €0)

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under Irish law.

11. Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal and health data. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

12. Termination and Data Deletion

You may stop using SmileAgent at any time. You may request deletion of all your personal data by emailing info@smileagent.ie.

We reserve the right to suspend or restrict access to the Service if we reasonably believe you are misusing it or violating these Terms.

13. Governing Law

These Terms are governed by the laws of Ireland. Any disputes arising from the use of SmileAgent shall be subject to the exclusive jurisdiction of the courts of Ireland.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
